Online order terms

These terms cover orders placed and paid for through lamarujabakery.es. Placing an order means you accept what is set out here, so it is worth reading — we have written it to be understood.

This is an English translation provided for your convenience. The Spanish version at lamarujabakery.es/encargar/condiciones is the legally binding text, and both versions say exactly the same thing.

Opening hours: Monday to Saturday, 08:30–12:30 and 16:30–20:30. Closed on Sundays.

2. What you can order, and how far in advance

You can order the products shown in the order form, with these minimum lead times:

The delivery date has to fall on a day we are open. We close on Sundays, and on some public holidays and holiday periods too: the calendar in the form will only let you pick valid days.

3. How an order works: paying is not confirmation

This is the most important thing on this page. When you pay, your order is registered and waiting for us to confirm it. It is not confirmed yet. Until we confirm it, you can cancel whenever you like, free of charge and with a full refund.

We check every order against that day's production and write to you within 24 hours during our opening hours. If we cannot take it on, we refund you in full: by the same method you paid with, normally within 3–5 working days and no later than 14 calendar days.

4. Prices and payment

Every price you see includes VAT. The full amount is paid upfront: we do not work with deposits or part payments.

Payment is taken through the BBVA Virtual POS (Redsys), by card or by Bizum. Your card details are entered directly into the bank's payment page: LaMaruja Bakery never sees, receives or stores any of your card details at any point.

If the payment is not authorised, the order is not registered and you are not charged anything.

Prohibited transactions

This merchant undertakes not to permit any transaction that is illegal, or that is considered by the credit card brands or the acquiring bank to have, or potentially have, the effect of damaging their goodwill or affecting them adversely. The following activities are prohibited under the card brand programmes: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder or cards. In addition, the following activities are also expressly prohibited:

5. Delivery and collection

If you choose either of the two home delivery options, we need a complete address and a working phone number.

If we cannot deliver because the address is wrong or nobody is there to receive it, or if you choose collection and do not come for it on the agreed day, we keep it for you until the end of the day after the agreed one. Because it is fresh product, after that we cannot keep it or refund the amount. If you are not going to be able to collect or receive it, write to us and we will find a way.

6. Changes and cancellations

If you want to change or cancel

Where a refund applies, the money goes back by the same method you paid with: normally within 3–5 working days and no later than 14 calendar days.

If we have to cancel

If production problems, a breakdown or force majeure mean we cannot deliver your order, we tell you as soon as possible and refund 100% of the amount. You can also choose to move the date instead of taking the refund.

7. Right of withdrawal: it depends on each item

Distance purchases generally carry a 14-calendar-day right of withdrawal. That right applies item by item, not to the order as a whole: a single order may contain items that carry it and items that do not. In the confirmation email we tell you, for each line of your order, which case it falls under.

Pastry products: no right of withdrawal

Our pastry products are excluded from that right, for two reasons the law sets out expressly (Article 103, paragraphs c and d, of the consolidated text of the Spanish General Law for the Protection of Consumers and Users, Royal Legislative Decree 1/2007):

Shop items: 14 days

Shop items that are neither fresh food nor personalised — homeware or textiles, for example — do carry the 14 calendar days of withdrawal, counted from the day you receive them. To exercise it, simply write to us at [email protected] before that period ends, with no need to give a reason. The item must be returned in a condition that allows it to be resold, and we refund what you paid for it — including the standard delivery costs corresponding to it — within a maximum of 14 calendar days from the moment you tell us. The cost of returning it is yours unless the item arrived faulty or was the wrong one.

An order containing pastry does not take the right of withdrawal away from a shop item in that same order, nor the other way round: every line keeps the right that corresponds to it.

None of this affects your rights if the product arrives in poor condition or does not match what you ordered: in that case, the next section is what applies.

8. If something is not right

If the product arrives in poor condition, does not match your order, or there is any problem at all, tell us as soon as you can — ideally the same day — on WhatsApp at 614 618 479 or at [email protected], with a photo if you can. This does not reduce your statutory rights as a consumer, which stand for the periods the law sets.

We will sort it out by replacing the product or refunding you, whichever you prefer. With fresh food, telling us quickly is what lets us really check what happened and put it right — the more time passes, the harder it is to piece together.

9. Allergens

We bake in a kitchen where cereals containing gluten, eggs, milk, nuts, peanuts, soya and sesame are handled. We cannot guarantee the absence of traces in any product.

If you have an allergy or an intolerance, say so in the allergies field on the form and check the allergen information for each product. If you have a serious allergy, write to us before ordering and we will talk it through.

10. Your data

The details you give us (name, phone, email and, where relevant, address) are used only to handle and deliver your order and to be able to contact you about it. We do not pass them to anyone except the bank that processes the payment, and we do not use them for marketing unless you expressly ask us to.

We keep order and invoicing data for 5 years, as tax law requires; everything else, for as long as our commercial relationship with you lasts or until you ask us to delete it.

You can exercise your rights of access, rectification, erasure, objection, restriction and portability by writing to [email protected]. If you feel we have not handled your request properly, you can complain to the Spanish Data Protection Agency (AEPD). The full detail is in our privacy policy.

11. Governing law

These terms are governed by Spanish law. If you are a consumer, you can bring any dispute before the courts of your own place of residence: that is the jurisdiction the law gives you, and no clause can force you into another one.

You can also file a complaint with Consumo Responde, the consumer service of the Regional Government of Andalusia, or with the consumer office of your own region.
